Josue Colon, Puerto Rico's Energy Commissioner, responded to a second information request from Resident Commissioner Pablo Jose Hernandez about the failed contract with Power Expectations, El Nuevo Dia reported Oct 16.[1] Colon said his account of the process is consistent with the testimony of former AEE director Mary Carmen Zapata and Osvaldo Carlo Linares, and denied inconsistencies between the statements.[2][3] Hernandez has now submitted two information requests on the contract.[4] The response follows an earlier request and keeps the Power Expectations contract inside Hernandez's inquiry. On the same date, Mary Carmen Zapata, the former Executive Director of the Puerto Rico Electric Power Authority (AEE), provided a declaration on the controversial bidding process that produced the deal.[5] Zapata has said Colon pressured her by text message to speed up signing of the contract, that she refused to sign on June 2 because legal documents were missing, and that she warned him on June 12 to follow proper process.[6][7][8] The roughly $5.9 billion temporary-generation contract was later cancelled over irregularity claims: the Fiscal Oversight Board revoked its approval, and Enchanted Rock said its name and signature were used on the contract without authorization.[9][10] The Oversight Board voted on Aug. 14 to revoke its approval, directed PREPA to terminate the contract, and referred the contract issues to law-enforcement authorities; as of that date, 66 days after execution, no significant progress had been reported. [11][12][13][14] The board later ratified the cancellation of the contract, valued at up to $5,886,720,000, citing the missing construction-phase performance bond and an attempt to substitute Flotek Industries for Enchanted Rock without approval; Power Expectations has denied all fraud claims.
