LUMA Energy told the Supreme Court of Puerto Rico that cancelling its public-private partnership with the Puerto Rico Electric Power Authority would cost AEE ratepayers and the General Fund about $1.3 billion.[1]
The partnership is the contract that put LUMA Energy in charge of transmission and distribution for the AEE.[2] In a sworn statement, LUMA Energy chief executive Janisse Quiñones said at least $726 million of that $1.3 billion represents mandatory payments for services the AEE has failed to fulfill over the past two years.[3]
The Puerto Rico Chamber of Commerce asked the Supreme Court of Puerto Rico for permission to intervene as amicus curiae in the case over the LUMA Energy contract extension.[4] The chamber argued that cancelling the partnership would severely damage Puerto Rico's credibility as an investment destination.[5]
A separate gas fight is running in parallel. Legal representatives for New Fortress Energy said a gas delivery delay stems from $92.2 million in disputed unpaid balances owed by the AEE.[6] Puerto Rico's Public-Private Partnership Authority said the interrupted natural gas supply from New Fortress Energy is costing about $1.25 million a day for replacement fuel.[7] At that rate, the replacement-fuel bill grows faster than the disputed balance does by the day.LUMA Energy informó al Tribunal Supremo de Puerto Rico que cancelar su alianza público-privada con la Autoridad de Energía Eléctrica costaría a los abonados de la AEE y al Fondo General alrededor de 1.3 mil millones de dólares.[1]
