Puerto Rico's Fiscal Supervisory Board told the island's Supreme Court on 20 October 2026 that canceling the LUMA Energy contract would cause catastrophic consequences for the electricity supply.[1]
The board filed an amicus curiae brief in the LUMA contract litigation.[2] It put a price on termination: over $250M in contractual charges, plus additional obligations.[3] LUMA is the private manager and operator of the grid, handling interconnection authorizations and electricity dispatch.[4]
The board also closed off the two routes back. It said the Puerto Rico Electric Power Authority no longer has enough staff to resume running the grid itself.[5] And it said no alternative capable operator currently exists,[6] with no qualified replacement private operator identified by the government.[7]
The government has not conceded the contract. Energy czar Josué Colón Ortiz said the government maintains that the LUMA contract extension document is legally invalid.[8] That position and the board's brief now sit on opposite sides of the same case before the court.
